Terms of Service

Welcome to Deqolo. These Terms of Service ("Terms") govern your access to and use of the Deqolo mobile application, website, and related services (collectively, the "Service") operated by Deqolo ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using Deqolo, you represent and warrant that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian to use the Service.

2. Account Registration

Some features of the Service require you to create an account. When you do:

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the Service

Permitted Use

Deqolo grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Upload content that infringes on the intellectual property rights of others
• Upload images containing explicit, harmful, or illegal content
• Attempt to reverse-engineer, decompile, or extract the source code of the Service or its AI models
• Use automated systems (bots, scrapers) to access the Service without our written permission
• Interfere with or disrupt the integrity or performance of the Service
• Resell, redistribute, or commercially exploit the Service or its output without authorization
• Impersonate any person or entity or misrepresent your affiliation

4. User Content

Your Photos

When you upload photos to Deqolo, you retain all ownership rights to your original images. By uploading, you grant us a limited, worldwide, non-exclusive license to process, store, and display your photos solely for the purpose of providing the Service to you.

AI-Generated Content

The AI-generated redesigns, recolors, and object replacements created by the Service are provided to you for personal use. You may:

• Save, download, and share AI-generated images for personal, non-commercial purposes
• Use AI-generated images for planning your own home renovation or design projects
• Share results on social media with appropriate attribution to Deqolo

You may not use AI-generated images for commercial purposes (e.g., selling designs, advertising for third-party services) without a separate commercial license from us.

Content Responsibility

You are solely responsible for the content you upload. You represent that you have the right to upload any photo you submit and that your content does not violate the rights of any third party.

5. Subscriptions and Payments

Free Tier

Deqolo offers a free tier with limited features and a set number of free AI redesigns. The availability and scope of the free tier may change at our discretion.

Pro Subscription

Our Pro subscription provides access to unlimited designs, all design styles, and premium features. By subscribing:

• You agree to pay the subscription fees displayed at the time of purchase
• Subscriptions automatically renew at the end of each billing period unless cancelled
• You may cancel at any time through your app store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods, except as required by law

Price Changes

We may change subscription prices from time to time. Price changes will be communicated in advance and will take effect at the start of your next billing period after notice.

6. Intellectual Property

The Service, including its design, AI models, code, graphics, logos, and all related intellectual property, is owned by Deqolo and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited license described above.

The Deqolo name, logo, and all related marks are trademarks of Deqolo. You may not use our trademarks without prior written consent.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the Service will be uninterrupted, secure, or error-free
• Any warranty regarding the accuracy, reliability, or quality of AI-generated content

AI-generated redesigns are intended for visualization and inspiration purposes only. They should not be relied upon as accurate architectural plans, structural assessments, or construction blueprints. Always consult qualified professionals for actual renovation work.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Deqolo and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use
• Cost of procurement of substitute services
• Any damages arising from renovation or design decisions made based on AI-generated content

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Deqolo and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload to the Service

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and associated data, subject to our data retention policy
• Provisions that by their nature should survive termination will remain in effect (including disclaimers, limitation of liability, and indemnification)

You may terminate your account at any time by deleting it through the app settings or contacting us.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Deqolo is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits or class-wide arbitration, to the extent permitted by law.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the app or via email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Service.

13. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Deqolo regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights without restriction.
